Credit Authorization and Disclosure

1. Overview

This Credit Authorization and Disclosure ("Authorization") is provided by CRE Loan Scout LLC ("we," "us," or "our") in connection with your application for a personal loan through our loan matching and referral service. By submitting an application through our website creloanscout.com or through any affiliated application channel, you acknowledge that you have read, understood, and agree to this Authorization.

We comply with the Fair Credit Reporting Act (FCRA), 15 U.S.C. ยง 1681 et seq., as amended, and applicable federal and state laws governing the use of consumer credit information. This Authorization explains how credit information may be obtained, used, and disclosed in connection with your loan application, and informs you of your rights under the FCRA and related consumer protection laws.

CRE Loan Scout LLC is a loan matching and referral service. We are not a lender. We connect borrowers with third-party lenders who may offer personal loans. The lenders in our network, and not CRE Loan Scout LLC, make credit decisions and may obtain and use credit reports in accordance with their own policies and applicable law.

2. Authorization to Obtain and Use Credit Information

By submitting a loan application through our Service, you expressly authorize and consent to the following:

  • Consumer Reports: You authorize CRE Loan Scout LLC, our service providers, and the lenders and lending partners in our network to obtain and use consumer reports (including credit reports) from one or more consumer reporting agencies (credit bureaus) such as Experian, Equifax, and TransUnion, or from alternative credit reporting providers, for the purpose of evaluating your application for credit, verifying your identity, assessing your creditworthiness, and determining your eligibility for loan offers.
  • Hard Credit Inquiries: You understand and agree that when you submit an application and are connected with one or more lenders, those lenders may obtain your credit report. Such inquiries may result in a "hard" credit inquiry on your credit file, which may affect your credit score. Each lender that accesses your credit report may generate a separate inquiry. You expressly authorize such inquiries to be made by lenders for the purpose of evaluating your application for credit.
  • Soft Credit Inquiries: You understand that we or our service providers may obtain a "soft" credit inquiry or pre-qualification check in connection with matching you with potential lenders. Soft inquiries typically do not affect your credit score and may appear in the "soft inquiry" section of your credit report, which is not visible to lenders when they review your credit.
  • Alternative Data: You authorize us and our partners to obtain and use alternative data sources, including but not limited to bank account verification, income verification, employment verification, and other third-party data providers, where permitted by law and applicable to the evaluation of your application.

3. Information Sharing with Lenders

You authorize CRE Loan Scout LLC to share the information you provide in your application, including but not limited to your name, date of birth, Social Security number, address, email, phone number, income, employment information, and other relevant data, with lenders and lending partners in our network for the purpose of evaluating your application and presenting you with loan offers.

We may share your information with multiple lenders simultaneously. Each lender may independently obtain your credit report and conduct its own evaluation. You understand that once your information is shared with a lender, that lender's privacy policy and practices govern how it uses and protects your information. We encourage you to review each lender's disclosures before accepting any loan offer.

Your authorization to share information is voluntary. However, if you do not provide this authorization, we will not be able to process your application or connect you with lenders, and you will not receive loan offers through our Service.

4. Fair Credit Reporting Act (FCRA) Compliance

Our use of consumer reports and the use of consumer reports by lenders in our network is governed by the Fair Credit Reporting Act (FCRA) and related regulations, including Regulation V (12 CFR Part 1022) issued by the Consumer Financial Protection Bureau. Key provisions include:

  • Permissible Purpose: Consumer reports may only be obtained for a permissible purpose under the FCRA, such as in connection with a credit transaction involving the consumer, the extension of credit, or the review or collection of an account. Your submission of application constitutes your authorization for such permissible purposes.
  • Accuracy and Integrity: Consumer reporting agencies are required to maintain reasonable procedures to ensure the maximum possible accuracy of the information in consumer reports. Creditors and users of consumer reports must comply with applicable obligations regarding the accuracy and use of such information.
  • Adverse Action: If a lender takes adverse action (such as denying your application) based in whole or in part on information in a consumer report, the lender must provide you with an adverse action notice that includes the name, address, and telephone number of the consumer reporting agency that furnished the report, a statement that the consumer reporting agency did not make the decision and cannot provide the reasons for it, and a notice of your right to obtain a free copy of your credit report and to dispute the accuracy or completeness of any information in the report.

5. Your Rights Under the FCRA

You have important rights under the Fair Credit Reporting Act. These rights include, but are not limited to:

  • Right to Know: You have the right to know what information is in your credit file. You may request a free copy of your credit report from each of the nationwide consumer reporting agencies once every 12 months through AnnualCreditReport.com or by contacting Experian, Equifax, and TransUnion directly.
  • Right to Dispute: You have the right to dispute the accuracy or completeness of any information in your credit report. Consumer reporting agencies must investigate disputes and correct or delete inaccurate, incomplete, or unverifiable information within 30 days (or 45 days in certain circumstances).
  • Right to Be Informed of Adverse Action: If a lender takes adverse action based on information in a consumer report, you have the right to receive a notice that includes the name and contact information of the consumer reporting agency that supplied the report.
  • Right to Limit "Prescreened" Offers: You have the right to opt out of receiving prescreened credit offers by calling 1-888-5-OPT-OUT (1-888-567-8688) or visiting www.optoutprescreen.com.
  • Right to Security Freeze and Fraud Alert: You may place a security freeze or fraud alert on your credit report. A security freeze restricts access to your credit report. A fraud alert notifies creditors to take extra steps to verify your identity before extending credit. Contact the consumer reporting agencies for more information.

6. Impact on Your Credit Score

You understand that applying for credit may result in one or more inquiries on your credit report. Multiple inquiries in a short period may have an impact on your credit score, depending on the scoring model used. Inquiries typically remain on your credit report for up to two years, although their impact on your score may diminish over time.

Soft inquiries (such as pre-qualification checks) generally do not affect your credit score. Hard inquiries (such as those made when a lender evaluates your application for credit) may affect your score. If you are connected with multiple lenders, each lender may conduct its own credit check, which may result in multiple hard inquiries.

We do not control how lenders use credit information or how credit scoring models treat inquiries. We encourage you to understand your credit situation before applying and to apply only when you are ready to pursue a loan.

7. Duration of Authorization

This authorization applies to the loan application you submit through our Service and remains in effect for a reasonable period necessary to process your application, match you with lenders, and allow lenders to evaluate your application and present you with offers. This authorization also applies to any subsequent applications you may submit through our Service.

If you are connected with a lender and accept a loan offer, the lender may have its own authorization and disclosure requirements for ongoing credit monitoring, account updates, or other purposes. Your relationship with the lender is governed by the lender's agreement and disclosures.

8. Revocation of Authorization

You may withdraw or revoke this authorization at any time by contacting us at [email protected] or (973) 587-2399. However, revocation will not affect:

  • Actions already taken in reliance on your authorization before we received your revocation
  • Any credit inquiries that have already been made
  • Information that has already been shared with lenders
  • Any loan offers you may have already received

If you revoke this authorization before your application is fully processed, we may not be able to complete the matching process or connect you with lenders, and you may not receive loan offers.

9. State-Specific Disclosures

Certain states have additional requirements regarding credit authorization and consumer rights. For example:

  • California: California residents may have additional rights under the California Consumer Credit Reporting Agencies Act (CCRAA) and the California Consumer Privacy Act (CCPA). You may contact the California Department of Financial Protection and Innovation for more information.
  • New York: New York residents may have additional rights under state law regarding credit reporting and consumer protection.
  • Other States: Your state may have laws that provide you with additional rights or protections. We comply with applicable state laws in the jurisdictions where we operate.

10. Accuracy of Information

You represent and warrant that all information you provide in your application is true, accurate, current, and complete. Providing false, misleading, or incomplete information may result in denial of your application, termination of your account, and may constitute fraud or illegal activity. You agree to promptly update any information that becomes inaccurate or incomplete.

If you believe that information in your credit report is inaccurate or incomplete, you have the right to dispute it directly with the consumer reporting agency. We do not control the content of credit reports and cannot correct information on your behalf.

11. No Guarantee of Approval

This authorization does not guarantee that you will receive any loan offers or that you will be approved for credit. Loan approval depends on the lender's evaluation of your application, creditworthiness, and other factors. We do not make credit decisions and are not responsible for any lender's decision to approve or deny your application.
